Lawsuit filed in Toyota unintended acceleration case
Graham Esdale discusses a lawsuit filed by the families of Jean Bookout and Barbara Schwarz of Yukon, Oklahoma. Toyota is accused of ‘negligence, failure to warn, breech of warranty and deceit.’
Bookout and Schwarz were traveling down an interstate in Oklahoma. With Bookout behind the wheel of her 2005 Toyota Camry, the car’s acceleration pedal suddenly got stuck. Bookout survived and Schwarz did initially, even telling witnesses at the scene what happened before dying later that night from internal injuries, according to their Montgomery attorney Graham Esdale.
Toyota has reportedly denied the car had any defective parts but Esdale says the car company has not explained what it thinks actually happened.
Meantime, Esdale is not surprised by Toyota’s decision this week to recall more than 2 million models because of acceleration issues.
The lawsuit is asking for compensatory and punitive damages from the car company.
